Terms of Service

These Terms of Service ("Terms") govern your access to and use of the HomeCanon mobile application (the "App") provided by HomeCanon ("we", "us"). By creating a HomeCanon account or otherwise using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old (16 in the European Economic Area) to use the App. If you use the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Your account

  • You sign in by entering an email address and tapping a one-time link we email to you.
  • You are responsible for the security of the email account you use to sign in. Anyone with access to that inbox can sign in to your HomeCanon account.
  • One person, one account: do not share account credentials. If multiple people in your home want access, use the household-member invite feature instead.

3. Household members and invites

  • Household members you invite can read and write all data in the household: appliances, schedules, warranties, and documents.
  • You should only invite people you trust. If a household member loses your trust, the household owner can remove them at any time from Settings → Household.
  • The household owner is responsible for the actions of household members within the household.

4. Subscriptions and billing

  • HomeCanon offers a free tier with limits on appliance and document counts, and a paid "Pro" tier sold as an auto-renewing subscription through the Apple App Store and Google Play.
  • Payment is charged to your Apple ID or Google Play account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
  • You can manage and cancel your subscription at any time in your App Store account or Google Play account, not from within HomeCanon.
  • Trial periods, if offered, convert to a paid subscription automatically at the end of the trial unless you cancel before the trial ends.
  • Refunds are handled by Apple and Google according to their standard policies. HomeCanon does not process refunds directly for App Store or Play purchases.
  • If your subscription lapses, your data is preserved but features above the free-tier limits become read-only until you renew or reduce your usage to free-tier limits.

5. Acceptable use

You agree not to:

  • Use the App to violate any law or infringe another person's rights;
  • Upload malware, illegal content, or content you do not have the right to share;
  • Reverse engineer, decompile, or attempt to extract source code from the App, except as permitted by applicable law;
  • Probe, scan, or test the vulnerability of our systems without our written authorization;
  • Use the App to send unsolicited messages or harvest data;
  • Resell, sublicense, or commercially exploit the App without our written permission.

6. Your content

You retain ownership of the appliances, warranties, photos, and documents you upload to HomeCanon ("Your Content"). You grant HomeCanon a limited license to store, process, and display Your Content solely for the purpose of providing the App to you and your household members. We will not sell Your Content or use it to train machine-learning models.

7. Service availability

We strive to keep the App available 24/7 but do not guarantee uninterrupted service. We may take the App offline for maintenance, updates, or security incidents. We may modify or discontinue features at any time; for material changes affecting paid features we will provide notice and, where required by law, a pro-rated refund.

8. Disclaimer of warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. HOMECANON DOES NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR THAT MAINTENANCE REMINDERS WILL ALWAYS BE DELIVERED ON TIME. THE APP IS A TOOL TO HELP YOU TRACK MAINTENANCE; IT IS NOT A SUBSTITUTE FOR PROFESSIONAL ADVICE FROM A LICENSED CONTRACTOR, ELECTRICIAN, PLUMBER, OR OTHER SPECIALIST.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HOMECANON WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS WILL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (b) USD 50.

10. Apple App Store additional terms

If you download the App from the Apple App Store, you acknowledge that these Terms are between you and HomeCanon, not Apple, and that Apple has no obligation to provide any maintenance or support for the App. Apple is a third-party beneficiary of these Terms and may enforce them against you. The standard Apple Licensed Application End User License Agreement applies to your use of the App on Apple devices.

11. Google Play additional terms

If you download the App from Google Play, your use is governed by the Google Play Terms of Service in addition to these Terms.

12. Termination

You may stop using the App at any time and delete your account from Settings → Account → Delete account. We may suspend or terminate your access if you violate these Terms. Sections that by their nature should survive termination (ownership, disclaimers, limitation of liability, governing law) survive.

13. Governing law and disputes

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in San Francisco County, California, and you consent to that jurisdiction. Nothing in this section limits any non-waivable rights you have under the law of your country of residence.

14. Changes to these Terms

We will update these Terms when our practices change and bump the "Last updated" date above. Material changes will be surfaced in the App. Continued use of the App after a change constitutes acceptance of the updated Terms.
